Fatca withholders to struggle without crucial instructions

Financial institutions set to act as withholding agents from July 1 when the anti-tax evasion law Fatca comes into force will struggle to operate effectively without a vital form that they are still waiting for, according to industry participants.

This week finally saw the release of the hotly anticipated W-8BEN-E form – the form used to identify non-US entities rather than non-US people. But Jonathan Jackel, Washington DC-based senior counsel at law firm Burt, Staples & Maner, points out that
