SENTENCING CHANGES

The US Sentencing Commission is to amend its sentencing guidelines for corporations, deleting the contentious clause that "encourages" federal agencies to seek attorney-client privilege waivers in corporate internal investigations. The Sentencing Commission promulgates sentencing policies for federal court.

The sentencing guidelines mandate compliance programmes in companies, and serve as a basis for the Justice Department's (DOJ) consideration of waiver of the attorney-client
